TERMS

GENERAL

By signing this rental agreement the renter confirms that she/he has fully understood and agrees with terms and conditions stipulated below. The renter gives ESK Surf OÜ (WINDY VAN) the right to process and store any personal information required for processing and fulfillment of the rental agreement. The renter agrees to pay any contractual costs, extras or fines that may arise from the rental agreement and gives ESK Surf OÜ (WINDY VAN) the power of attorney to debit any contractual costs, extras or fines from security deposit or credit- or debit card provided to us.

NECESSARY DOCUMENTS

The renter must present a valid drivers’ license, personal ID (ID card or passport) and a sufficient security deposit. Only the person renting the car is authorized to drive the car. The rental agreement is considered as the power of attorney. Additional drivers can be added for a fee. Drivers must be at least 21 years old and have a driver's license for at least 2 years.

PAYMENT TERMS

The rental price (including extras) is pre-paid before the start of the rental period. The final balance is calculated at the end of the rental period and is based on the actual duration and any additional fees if applicable.

On reservation and paying the security deposit we accept payment by credit- or debit card or bank transfer. We also accept cash on prior notice.

In case of early return the excess payment is not returned unless agreed upon differently. 

Late payments charged a daily fee of 0.5% from the unpaid amount.

DEPOSIT

Before the rental period starts we charge a deposit of 500 euros. The deposit is used for possible damages as well as fines and other claims from third parties. The deposit is returned within 1-3 working days after the car has been returned and overseen for damages.

RENTAL PERIOD

Day = 24h starting from the pickup time

Week = 7 days

Month = 30 days

CAR HANDOVER AND RETURN

The car is given to the customer with a full tank of fuel, clean and in a good technical condition. Upon return, we expect the car to be in the same condition upon returning. Clean and filled up.

MILEAGE RESTRICTION

The rental price includes mileage purchased by the renter. Standard restriction is 300 km per day, but not exceeding 2000 km per month. In case the mileage restriction is exceeded we charge an extra fee of 0,5 euros per kilometer.

CAR USAGE

Please treat our car like your own: drive responsibly and keep it tidy!

The renter is responsible for paying all road taxes, parking fees or any other charges that may apply while using the car. We expect you to use the car in good faith and return it in the same condition it was given to you at the start of the rental period.

We do accept the return of the car that is not completely fueled but charge a fee of 50 euros plus the cost of fuel for this.

Upon return, the car must be reasonably clean. We have accounted for a basic car wash and vacuuming post-rental. 

Please comply with traffic regulations, best practices and existing legislation. Smoking or consumption of drugs/alcohol is prohibited in the car.

It is not permitted to drive outside of the Republic of Estonia unless previously agreed upon with ESK Surf OÜ (WINDY VAN) in writing.

It is forbidden to drive on unofficial roads or roads without proper foundation or on roads where the surface may endanger the cars’ tires, rims, suspensions or other parts of the car.

It is forbidden to take the car to a racetrack or participate in any official or unofficial races. Do not use the car for driving lessons, paid passenger transport, to carry dangerous goods, livestock etc. Do not wash the car in an automatic washer that uses brushes as the brushes and powerful water streams can damage the protective adhesive or paint.

The car has remote tracking and reports misuse (like driving at excessive speeds or outside designated borders), this information is also available retroactively and is used to determine possible fines.

PENALTIES AND ADDITIONAL FEES

Rental prices include mileage according to the rental period, regular maintenance, mandatory insurance (third party liability) and 24h roadside assistance insurance. Fuel is not included in the rent. The car is handed over to the renter with a full tank of fuel. The car must be returned with a full tank of fuel. 

When the damage is caused by the driver not taking due care, not paying attention, is reckless or negligent. This includes and is not limited to: adding improper fuel, not following the traffic laws, damages to the car while parking or in a parking facility, burned clutch, using the hand brake incorrectly etc

In case of theft or roll-over incident (car is not restorable) we charge a fee of 6000 EUR (BASIC) or 10000 EUR (GRANDE) without exceptions, despite which insurance package the renter has purchased.

Self-risk is to be paid by the renter for every insurance case. Multiple cases during the rental period are treated as separate cases. The keys and documents are not insured and in case of their loss or damage the customer is obliged to cover all costs due to their replacement.

Driving with the car in excess of the allowed speed limit +40km/h the penalty is 100 euros to which any speed above the baseline will add 10€ per 1km/h. The speed is determined from the tracking reported by the car and is independent of any police investigation. In and near populated areas the fines for speeding are doubled.

If a thorough cleaning of the interior is required the fee is 25 euros. For a chemical full cleaning the fee is 100€.

Missing or damaged extras or equipment from the car results in a penalty of 50 euros plus the costs of replacing the missing or damaged equipment.

Loss of car documents results in a penalty of 50 euros plus any costs associated with replacement of the documents.

Loss of the car key results in a penalty of 50 euros plus the cost of replacement keys.

Allowing the car to be driven by anyone outside of the agreed contract results in a penalty of 500 euros.

Smoking in the car is not allowed and results in a penalty of 300 euros to cover the deep cleaning of the interior.

Failing to return the car on time at the end of the rental period (+/- 2 hours) adds a fee three times the standard rate for the excess days unless agreed upon differently in advance. If the late return causes loss of another rental contract the renter will cover the damages unless agreed upon differently in advance.

Damages caused by negligence, using the car unpurposefully of contrary to what the manufacturer has mandated results in a penalty of 1000 euros plus any costs associated with restoring the car to the same condition it was prior to the rental period.

DEMANDS FROM THIRD PARTIES

All damages/fines caused by the renter to third parties during the rental period (e.g. speeding tickets, parking fines etc.) plus a fine of 30 euros in addition to any demands from the third parties is to be paid by the renter.

By signing the rental agreement the renter gives ESK Surf OÜ (WINDY VAN) the right to debit all fines or added fees from the credit card, debit card or security deposit the renter has provided after the end of the rental contract.

UNFORESEEN CIRCUMSTANCES

Sometimes due to unforseen circumstances (crash, vehicle theft, etc) we are unable to supply the car requested. ESK Surf OÜ (WINDY VAN) will take no responsibility if the booked car is not physically present in the depot and therefore not available due to external conditions beyond our control. We will always do our best to supply a car of similar quality and characteristics when possible.

OTHER CONDITIONS

These conditions are in effect simultaneously with the rental contract.

 In case of conflict the current conditions apply (except deductible rates). ESK Surf OÜ (WINDY VAN) does not cover in case of car failure any associated costs to customers travel plans neither direct nor indirect. ESK Surf OÜ (WINDY VAN) has the right to change pricing and conditions without prior notice.

PROCESSING OF PRIVATE DATA

Any customer data stored by ESK Surf OÜ (WINDY VAN) is considered confidential and not disclosed to third parties. The company does not disclose information to third parties unless required by law. Communication between the customer and banks or credit card payment system is encrypted. ESK Surf OÜ (WINDY VAN) does not have access to customers' confidential bank or card information. Private data supplied to ESK Surf OÜ (WINDY VAN) during the sale of services and products is protected and handled according to private data protection legislation in Estonia. Private data is only gathered with the purpose of sales analysis and summaries as well as making offers to customers or for feedback polling. The private data of the customers is processed by ESK Surf OÜ (WINDY VAN). We may subcontract other companies to process the private data, but will sign a separate agreement to do so, which will require confidentiality from the third party.

INSURANCE

Rental prices include mandatory third-party liability insurance. It is compulsorily held by the car owner and it provides coverage to damages to other vehicles and injury to other drivers. For the costs that insurance does not cover we may charge the renter. For better protection and peace of mind we encourage you to select additional insurance.
